Terms and Conditions

Important information about your rental

On arrival you will be required to sign a rental agreement with the operators / owner of EMILUX Camper Hire... Here is a summary of the terms and conditions:

Definitions

  • The following definitions apply for the terms and conditions for EMILUX Camper Hire.


  • The Supplier means the operator /owner of EMILUX Camper hire.
  • The Client is also referred to as the Hirer (s)

Upon confirmation of this booking a non-refundable deposit will be taken from your nominated credit Card. This will secure your booking. I addition to this,
the following terms and conditions apply:

1.       Hire of camper
(a)     EMILUX Camper Hire (the supplier) hires to the Customer this vehicle in terms of these general conditions of hire.

2.       Deposit and hire charges
(a)     The Hirer shall pay to the supplier a deposit, which shall be refunded within 30 days after the return of the vehicle to the place from which it was hired.
(b)     The hire charges, at the rates signed for, are payable in advance unless otherwise arranged.
(c)     The Hirer shall pay for any damaged or lost item that belongs to the supplier.

3.       Period
(a)     The initial period for which the Camper is hired shall be stated on the contract.
(b)     The hire period shall commence when the Client takes delivery of the Camper and shall end when the Supplier accepts the return of the camper.

4.       Camper in good order and Condition
(a)     The camper shall be deemed to be in good order and repair and fit for the purpose for which it is intended when delivered to the Client, unless the
Client notifies the Supplier of any defects immediately on taking delivery of the said Camper.
(b)     The supplier shall, in its sole discretion decide whether the camper is defective or unfit for the purpose for which it is intended, and shall be
entitled to terminate this agreement and refund the deposit and any hire charge paid, or shall replace the defective Camper.

5.       Breakdowns and repairs
(a)     The Client shall, maintain the camper and its belongings, in good running order and repair to the standards required by the supplier until the
camper is returned to the supplier.
(b)     The camper is less than 5 years old, but minor problems can always arise.  Minor repairs done while travelling by the Client could be reimbursed
on presentation of a receipt on return. The Client shall be entitled to repair or replace the camper at his cost, unless the supplier in its sole discretion,
determines that the breakdown is due to improper use of or failure to service and maintain the said camper, in which event the Client shall on demand,
reimburse the supplier with all costs incurred as a result of the breakdown.
(c)     The Client shall return the camper in a clean state and in good order and repair, fair wear and tear excepted. In the event of the camper or any of its
belongings being lost destroyed or damaged as a result of any cause prior to the return of the camper, the Client shall be liable to make good the
replacement cost thereof and hire charges continue until the Client has paid for or replaced the lost camper and/or its belongings.

6.       Use of camper
(a)     The Client acknowledges that he is aware of the purpose for which the vehicle was designed, as well as all safety and maintenance procedures
which are required of the vehicle by any lawful authority, and shall only use the vehicle for such purpose, and shall comply with all such safety and
maintenance procedures. The Client shall be liable to and herby indemnifies the Supplier for all damage or loss suffered by the supplier should the
vehicle be used for any other purpose, or should the Client fail to comply with any required safety and maintenance procedures.
(b)     The Client shall use the camper at his own risk. The Client shall have no claim of any nature against the supplier of the vehicle, for any loss
suffered or damages sustained by the Client arising from any cause, including, without any limitation, the use of the camper and provisions thereof.
The Supplier also does not take responsibility from damages arising out of fast speeds and long distance driven on washboards roads. Damages
caused by Vis Major e.g. flash floods, lightning strikes and hail storms are not covered by our insurance waivers.

7.       Access
(a)     The Client shall, at all times, be responsible for the camper prior to the return thereof, and shall return it to the supplier at the expiry of the hire
period or on cancellation of the agreement.
(b)     The supplier shall at all reasonable times be entitled to have access to the camper, for the purpose of inspecting or repairing the vehicle.

8.       General
(a)     The supplier will not be responsible for hotel or other accommodation due to the immobilization of the vehicle for any reason and will make
refunds for time lost while the vehicle is being repaired, at our sole discretion.
(b)     The client is liable for all traffic offences incurred whilst the vehicle I on hire.
(c)     Refrigerator, stove, microwave and the air conditioner are checked by the supplier and the client before every rental, consequently the supplier
does not accept liability for any possible malfunction of these units during the rental period.
(d)     The vehicle must be returned by no later than 4 pm on the last day of hire or an extra day could be charged.

OTHER IMPORTANT INFORMATION

Minimum age of driver is 35 years.  A valid national/international driver’s license to be submitted.

Permitted area of travel:
The motor home is allowed to travel on any properly tarred surface.  Good smooth sands roads (non-corrugated) are also permitted. There are however areas
that are not suitable for driving with the motor home.  These are:  the Swartberg Pass (SA), the Sani Pass (SA), Kalahari Gemsbok Park (Kgalagadi
Transfrontier Park), the road to the Sentech Towers in Marakele Park (SA), Baviaanskloof Pass (SA), 4x4 trails, narrow and steep single lane mountain passes
and any road in South Africa that do not adhere to the condition of roads as mentioned above.  The owner also does not take responsibility for any damages
arising out of fast speeds and long distance driving on the washboard roads.  These include air conditioners, radiators, tyres and shocks. 
Please note that no border crossing permitted.

Accidents
By law all accidents must be reported to the supplier and the local Police within 24 hrs.  Failing to report accidents voids all insurance cover and the hirer
becomes fully liable for all cost.

Personal injury and belongings are not covered by our insurance.  The client is therefore responsible to obtain his or her own travel insurance.

Insurance Cover & Excess Information
5 % of the claim minimum R2500.

Exclusions:
The hirer will be fully liable for any damage to the supplier vehicle or third party vehicle or property if:
-          The terms of the rental contract are breached
-          Damage to the vehicle is caused by careless or reckless driving.
-          Damages caused by flash floods, lightning strikes, hard winds and /or hail (Act of God –Vis Major)
-          Driving on any 4x4 man-made tracks that requires an entrance fee.
-          Damage to the vehicle caused by incorrect use of the clutch or handbrake.
-          Driving under the influence of drugs or alcohol.
-          Driving on restricted roads/areas.
-          Water submersion or salt-water damage is caused.
-          Any roll-over damages of any kind – no matter at what speed.
-          Failure to switch off the engine when dashboard lights indicate a major problem e.g. oil light, radiator water temperature gauge.

Accidents and damage caused by these will result in the up to full excess being applicable.  Excess is payable in all circumstances whether you are at fault or not. 
Excess will be returned when party at fault has paid the supplier. Excess is also payable for third party damages.  Engine, gearbox and clutch failure due to abuse 
falls outside any insurance.  Accidents and collisions is what are covered by the insurance.  Any damaged clutches will be sent for a failure report. 
Until the outcome, the repair costs and other related costs are for the customer.  Driving in the dark, speeding and driving on the wrong side of the road often 
causes accidents by the hirer.  Never drive faster than 100 km/h on tarred roads and 60 km/h on sand roads. 

9.       Cancellation Costs
If you cancel the following charges will apply. These are in addition to the deposit paid when you made the booking:
90 days before departure: 10% of all costs
60 days before departure: 25% of all costs
30 days before departure: 50% of all costs
15 days or no show:        100% of all costs

We strongly recommend that Clients ensure they take out the highest level of Travel Insurance. In many cases this will cover any loss incurred if 
you are forced to cancel your booking.

10.    Parking / speeding traffic offences
The supplier reserves the right to charge the Client for any speeding or parking fines, associated administration costs and / or accidents including
third party vehicle / property damages not reported on the return of the vehicle.

11.    Currency fluctuations
All credit card transactions are conducted in South African Rands (ZAR). Due to exchange rate fluctuations there could be some variance in amount refunded compared to the amount initially charged. If a credit card is presented as payment, the credit card holder will be jointly and severally liable as a Client.

12.    Liability
To the extend permitted by law we / the owners of this website will not be liable to you or any third party (whether in contract, tort or otherwise) for 
any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your
reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or
procured through this website.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the Dollar amount of the 
deposit we have received from you in relation to your booking / rental. Refunds will not be made for bookings cancelled due to inclement weather. Again 
we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of South Africa and the jurisdiction of the 
South African courts.

13.    Booking information
To make a booking you must complete our booking form which is easy to follow. Once we receive your form, we will subject to availability, confirm
your booking by emailing you a confirmation voucher and Invoice. The deposit required to secure your vehicle will only be processed on your credit
card when booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes
non-refundable and any cancellation fees stated in the supplier’s terms apply. Upon receipt of your confirmation, please check your details carefully
and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservation
consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the Client to ensure they make
themselves fully aware of the terms.

14.    Amendments
Please not that: To recalculate the entire booking amount (not just the days changed).  If the rental period is increased, an additional deposit may
be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the
difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). Any alterations are subject to
availability and the approval of EMILUX. The alteration fee will not be charged if your alteration requested is not possible.

15.    Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your
insurance may be invalidated. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your
entire luggage in to the vehicle. It is your responsibility to choose a journey that is within your capabilities.  A vehicle supplier can refuse to rent
a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further
liability to you.
